Potential Exam Questions – Exam 1

 

• The IUS administration has passed a new policy. In order to distribute material on campus, the material must first be reviewed by Administrative Affairs for “Hate Speech.” The IUS Civil Liberties Union is suing IU Southeast on the grounds that this policy is violates free speech. Defend the university’s policy.

 

• John, Shelia and Bob work for a local bank. John sent Shelia an e-mail that said, “Bob is gay.” Shortly after this e-mail was sent, Bob stopped being invited to social events held by fellow bank employees. Bob filed a libel suit against John. Prosecute the case for Bob.

 

• Sally is a sophomore in high school and a member of the cheerleading squad. The cheerleaders marched in a parade, which was photographed by Jimmy, a freelancer photographer. Jimmy was so taken by his shots of the cheerleaders, he asked all of them to sign a release form, in case he ever wanted to produce a book of his photographs. The release was standard. The squad each received a free photo for their consideration. Jimmy later produced his book. The cover shows a mug shot of Sally smiling during the parade. Jimmy titled his book, “Walking the Street,” because the book is primarily shots from parades. Sally’s parents sue Jimmy for invasion of privacy. How would you argue the case for Sally’s parents?

 

• Betty is a member of the Supreme J.K. Rowling Fan Club. As a member of the club, she is invited to exclusive lectures and readings by Ms. Rowling. At one of these events, Ms. Rowling outlined and read a chapter from her next work, “Wizards in the Wild.” Betty was so inspired by the story that she went home and wrote a screenplay similar to “Wizards in the Wild” called “Wild Wizards.” Betty sold the screenplay to a movie studio. Ms. Rowling decides to sue Betty for copyright violation. Defend Betty.
